This Privacy Policy describes how HealthVivo, Inc. collects, uses, and discloses Personal Information through the HealthVivo Healthcare Operating System, available at www.healthvivo.com and via mobile application. By using the Service, you agree to this Policy and the Terms of Use.
"Personal Information" means information about you that can reasonably be linked to you, such as your name, social security number, health information, demographic information, and other identifiers as defined under state and federal law.
What Information We Collect and Maintain About You
Personal information from accountholders may include: name, email address, birth date, gender, race/ethnicity information, state of residence, payment method, username, and password.
HealthVivo Platform information includes:
- Medical history and healthcare provider information
- Family Health Profile data about family members' health
- Health insurance information
- Self-reported health information
- Wearable device and health tracking app data
- Payment details for processing transactions
Site or App information: Name and email for features like newsletter signup and Health Education Hub access.
Web log data: IP address, domain name, pages visited, visit dates/times, downloaded files, referral URLs, software/hardware attributes, device IDs, geographic location, and cookie information.
Cookies: Small files stored by your browser that recognize repeat visits and store user preferences. You may refuse cookies through browser settings, though some Service features may not function properly.
Web beacons: Single-pixel electronic files embedded in web pages or emails transmitting information, including Personal Information.
Third-party tracking: We partner with third parties to collect, analyze, and use information for online interest-based advertising.
How We Use and Process Your Information
Legal bases for processing Personal Information include: legitimate business interests, contract performance and fulfillment, your consent, and legal compliance.
We use collected information to:
- Provide the Service, including Family Health Command Center features
- Deliver personalized health insights and preventive care recommendations
- Enable conversational health intelligence through AI assistant
- Facilitate healthcare navigation and provider comparison
- Coordinate care across family members and healthcare providers
- Respond to questions or requests concerning the Service
- Fulfill agreement terms
- Process payments and complete transactions
- Send newsletters, health education content, updates, and promotional emails
- Improve artificial intelligence and machine learning capabilities
- Deliver confirmations, account information, notifications, and appointment reminders
- Improve user experience and product quality
- Comply with legal and regulatory requirements
- Aggregate and deidentify information
- Analyze visitor usage patterns and feature utilization

With Whom and Why We Share Your Information
Third-party service providers: Web-hosting companies, mailing vendors, analytics providers, payment processors, and cloud storage providers performing services on our behalf.
Healthcare providers and insurers: At your direction, we may share health information to facilitate care coordination, appointment scheduling, insurance pre-authorization, and healthcare services.
Analytics: Third parties help analyze collected information using web logs, web beacons, and cookies. The Service uses Google Analytics.
Interest-based advertising: For non-accountholders, third-party tracking mechanisms collect information for online interest-based advertising.
Note: We do not use third-party advertising trackers for accountholders (once logged in).
Legal purposes: We may share information when necessary to comply with applicable law, court orders, subpoenas, or legal process; investigate, prevent, or act on illegal activities, suspected fraud, terms violations, or threats to property or safety; establish, protect, or exercise legal rights or defend against claims; facilitate financing, securitization, insurance, sale, assignment, bankruptcy, or asset disposal.
Aggregated and de-identified information: We may publish reports on usage trends or healthcare insights from anonymized data without personal identification.
Your Privacy Rights
Contact privacy@healthvivo.com to learn about, update, change, or delete Personal Information.
Opt out of marketing emails and texts by following message instructions or emailing privacy@healthvivo.com.
Residents of jurisdictions with applicable data privacy laws may have rights including:
- Access your Personal Information (including data portability)
- Correct or amend Personal Information
- Delete your Personal Information
- Limit use of "sensitive" Personal Information
- Opt-out of sale or "sharing" of Personal Information
- Opt-out of targeted advertising use
- Restrict or object to processing (such as direct marketing)
- Restrict or opt-out of automated decision-making
- Revoke consent
- Confirm whether Personal Information is being processed

We employ technical, physical, and administrative safeguards including secure storage, transmission technologies, encryption, firewalls, access control, and audit measures to protect Personal Information confidentiality, integrity, and accessibility.
Data Breach Notification
In unauthorized access or disclosure events, we notify via email associated with your HealthVivo account.
Data Retention
We retain Personal Information as long as reasonably necessary to fulfill relevant Policy purposes and during legally required or permitted periods.
Children
The Service is not designed for children under 16. No one under 16 should provide information. We don't intentionally collect Personal Information from children. Contact privacy@healthvivo.com immediately if you believe we may have collected information from a child under 16.

Service hyperlinks may lead to unaffiliated websites. HealthVivo doesn't control these sites' data handling practices.

Right to Delete: Request deletion of collected personal information, subject to exceptions.
Right to Correct: Correct or amend personal information on file.
Right to Opt-Out of Sale or Sharing: We don't sell or share personal information.
Right to Limit Sensitive Personal Information Use: We don't use personal information in ways requiring Right to Limit provision.
Right to Nondiscrimination: We won't discriminate for exercising CCPA rights.

Shine the Light Law
California's "Shine the Light" law requires businesses to respond to customer requests about third-party personal information disclosure for direct marketing. We don't disclose personal information for these purposes.
Consumer Health Data Privacy Policy
This Consumer Health Data Privacy Policy applies to Consumer Health Data collected and processed through the HealthVivo Healthcare Operating System.
Definitions
"Consumer Health Data" means Personal Information linked or reasonably linkable to consumers identifying past, present, or future physical or mental health status, including information regulated under Washington's My Health My Data Act and similar health privacy laws.
Collection of Consumer Health Data
Collection categories include:
- Health conditions, treatment, diseases, diagnosis
- Social, psychological, behavioral, medical interventions
- Health-related surgeries or procedures
- Prescribed medication use or purchase
- Bodily functions, vital signs, symptoms, health measurements
- Gender-affirming care information
- Reproductive or sexual health information
- Genetic data
- Family health history and family member health conditions
- Precise location indicating health services acquisition attempts
- Information derived from non-health data associating with above categories
Sharing of Consumer Health Data
We may share Consumer Health Data with service providers performing services for HealthVivo, and with healthcare providers and insurers at your direction for care coordination.
Exercising Your Rights
Per applicable law, you may have Consumer Health Data rights including confirming collection, accessing your data, withdrawing consent, deleting data, and correcting data. To exercise these rights, email privacy@healthvivo.com.
If your information is protected by Washington's My Health My Data Act and we deny your request, file complaints through the Washington Attorney General's office.
